Abbas v. State,

PLD 2010 Quetta 1 · Balochistan High Court

This case involved three men, Abbas and two others, who had been charged with robbery (section 392 of the Pakistan Penal Code) and causing injury (section 337-F). During the trial, the complainant forgave the accused and both sides reached a compromise. However, the trial magistrate and later the Sessions Judge in Kharan rejected this compromise entirely, reasoning that robbery under section 392 cannot legally be compounded (settled between parties).

The accused challenged this rejection before the Balochistan High Court. The Chief Justice, assisted by several lawyers acting as amicus curiae (friends of the court), agreed that robbery under section 392 indeed cannot be compromised since it is not listed among compoundable offences in the Criminal Procedure Code. However, the court found that the lower courts had made an error by failing to separately consider the injury charge under section 337-F, which the law does allow to be compromised with court permission.

The High Court accepted the compromise for the section 337-F charge and acquitted the accused of that offence, drawing on Islamic teachings about the value of forgiveness and mercy. Regarding the more serious robbery charge, the court left open the possibility that the accused could apply to the state for withdrawal of that case, and noted the state should consider such an application promptly.

This ruling matters because it clarifies that courts must examine each criminal charge separately when parties compromise, rather than rejecting an entire settlement just because one charge happens to be non-compoundable.
