Fateh Muhammad v. State,
PLD 2010 Qta 67 · Balochistan High Court
This case involved Fateh Muhammad, who was stopped during a routine police check in Quetta in 2003 while driving a vehicle that turned out to have a registration book later found to be forged. He was charged and convicted by the Sessions Judge under sections of the Pakistan Penal Code dealing with forgery and using a forged document as genuine, and sentenced to three years' imprisonment plus a fine.
On appeal, his lawyer argued that he had purchased the vehicle from another person and had no knowledge the registration book was fake, presenting a sale agreement to support this claim. The Balochistan High Court examined the evidence and found that the prosecution had not proven that the appellant himself prepared the forged document, or that he knowingly used it while aware it was forged. The court emphasized that simply possessing a forged document is not a crime unless it is knowingly and fraudulently used as genuine.
Since the prosecution failed to establish this knowledge or intent beyond reasonable doubt, the court held that the conviction could not stand. The appeal was allowed, and Fateh Muhammad was acquitted.
This judgment matters because it reinforces an important legal principle: criminal liability for forgery-related offenses requires proof of guilty knowledge and intent, not mere possession of a suspicious document. This protects innocent buyers who unknowingly come into possession of fraudulent paperwork through no fault of their own.
