Muhammad Anwar v. Abdul Hameed,

PLD 2010 Qta 33 · Balochistan High Court

This case involved a landlord, Muhammad Anwar, who filed four separate eviction applications against tenants renting properties in Quetta. He argued the tenants had defaulted on rent payments, altered the properties from residential to commercial use without permission, and that he needed the properties back for his own bona fide personal use, since he intended to return from the United States to Pakistan with his family. The tenants contested this, arguing the Rent Controller lacked jurisdiction since only open land had been rented, and claimed the landlord was well-settled abroad and did not genuinely need the properties.

The trial court (Rent Controller) dismissed the eviction applications, partly relying on testimony from witnesses who were themselves parties in related proceedings. The Balochistan High Court found this improper, holding that such interested witnesses' statements were inadmissible against the landlord.

More significantly, the High Court ruled that a landlord's decision to live abroad does not automatically defeat a claim of bona fide need for ancestral property in Pakistan. It held that owning other property, or being "well settled" overseas, cannot by itself disqualify a landlord from reclaiming his property—the choice of which property to live in is the owner's prerogative. The landlord's own statement was deemed sufficient proof of genuine need.

The High Court set aside the Rent Controller's dismissal, allowed the eviction applications, and allowed all four appeals. This case reinforces landlords' rights to reclaim property for personal use, even if they have alternative accommodations or reside abroad.
