PLJ 2018 Islamabad 124

PLD 2008 SC 673). Paragraph 9 of the said report is reproduced herei · Lahore High Court

This case involved Park View Enclave (Private) Limited, a company developing a housing scheme called Park View City in Zone-IV of Islamabad, on land it had purchased for the project. The Capital Development Authority (CDA) had approved the layout plan in 2013 and later issued a No Objection Certificate (NOC) in 2014 allowing development, subject to several conditions, including following the approved layout and transferring land for roads, parks, and public buildings to CDA free of charge.

CDA later cancelled the NOC, finding that the petitioner had failed to comply with the conditions attached to it. The company challenged this cancellation in the Lahore High Court, asking that the cancellation be declared illegal and the NOC restored.

The court dismissed the petition. It found that despite repeated warnings from CDA to stop unauthorized construction, the petitioner continued development work in violation of the approved terms, essentially taking a calculated risk. The court held that such conduct did not entitle the petitioner to relief under the High Court's discretionary constitutional jurisdiction. It also noted that compliance with CDA's NOC requirements could not be excused merely because of the scheme's size or the financial stakes involved, and that courts could not validate construction carried out while the NOC was cancelled.

The judgment reinforces that developers in Islamabad must strictly follow CDA regulations and warnings, and that courts will not reward parties who proceed with construction despite clear notice that they are acting outside legal approval.
