Mumtaz Qadri Case Judgment by Supreme Court of Pakistan

PLD 2004 Lahore 199), · Lahore High Court

This is the Supreme Court of Pakistan's judgment in the Mumtaz Qadri case, deciding two appeals arising from an Islamabad High Court decision. Mumtaz Qadri was an elite police guard assigned to protect Salman Taseer, then Governor of Punjab. On 4 January 2011, Qadri shot and killed Taseer using his official weapon and immediately surrendered to fellow guards. He was tried under anti-terrorism laws and murder provisions, and did not deny the killing, justifying it instead on religious grounds, claiming Taseer was an apostate for expressing sympathy toward a woman convicted under blasphemy law.

The Supreme Court emphasized that its role was to apply the existing law of the land, not to rule on religious or theological questions, which fall outside its constitutional jurisdiction and belong instead to specialized religious courts and bodies. The judgment opens by citing Quranic verses stressing the duty to verify information before acting on it, framing Qadri's actions as based on unverified assumptions rather than confirmed facts.

The text provided cuts off before the final verdict is stated, but it lays out the factual background, trial evidence (including ballistic matching, medical evidence, and a recorded confession), and the appellant's defense. The case is significant because it involved the assassination of a sitting provincial governor by his own security guard over an allegedly blasphemous political stance, raising major questions about the rule of law, religious extremism, and the justice system's handling of a religiously motivated killing.
