Bail Granted on delay in Justice
PLD 2003 SC 668; Khalid Saigol v. The State PLD 1962 SC 495; Ahmad · Lahore High Court
This case is about a man named Sardar Muhammad Naseem, accused of corruption-related offences involving fraudulent stamp paper refund vouchers during his time at a District Commissioner's office. He was being tried under the National Accountability Ordinance and had been in custody since January 2001, meaning the trial had dragged on for about five years, with 222 adjournments, 141 of which were requested by the prosecution itself.
He asked the Lahore High Court for bail, arguing that the prolonged delay violated the law's own requirement that NAB trials be completed within 30 days, and that such extreme delay was unfair and contrary to justice.
The High Court agreed that justice delayed is justice denied. It noted that while serious crimes may require longer trials, this should not become an endless process, and that both the courts and NAB prosecutors are obligated to ensure speedy, efficient, and honest trials. The court questioned whether NAB prosecutors were adequately following the law's timeline requirements and said authorities needed to take corrective measures, or public confidence in anti-corruption efforts would suffer.
Since the trial showed no sign of ending soon and the defence had not yet even presented its witnesses, the court granted the petitioner interim bail, requiring a bail bond of one million rupees with a surety, regular court appearances, and surrender of his passport.
This case highlights the right to a timely trial and accountability for excessive delays in NAB cases.
