Suit for possession through pre-emption by Co-sharer
PLD 1994 SC 162, 2003 SCMR 686, 2004 SCMR 1719, 2006 SCMR 1410, 2008 · Supreme Court of Pakistan
This case is about a dispute over land pre-emption rights in Punjab. The respondent, Ayaz Mehmood, claimed a right to purchase land that had been sold to the petitioner, Muhammad Sadiq, by exercising his pre-emption right as a co-sharer in the property. Under pre-emption law, a person with a prior claim to land (such as a co-owner) can step in and buy it on the same terms when it is sold to someone else, provided they follow strict legal formalities, including promptly declaring intent (talab-e-muwathibat) and sending a formal notice (talab-e-ishhad) to the buyer.
The trial court dismissed the suit, citing contradictions in witness statements. However, the appellate court reversed this, finding that the respondent had properly completed the legal requirements, including sending the notice by registered post, which the petitioner never specifically denied receiving.
The Supreme Court upheld the appellate court's decision. It ruled that since the petitioner never swore under oath that he did not receive the notice, and no postal record showed refusal of delivery, the notice was legally presumed to have reached him. The Court also held that minor, trivial contradictions in witness testimony should not be used to defeat genuine property rights. Finding no legal error in the High Court's earlier handling of the matter, the Supreme Court dismissed the petitioner's revision.
This case reinforces how pre-emption claims are evaluated, emphasizing that unchallenged evidence of notice delivery is sufficient and that courts should not dismiss val
