Party can be added at any stage of the Trial

PLD 1992 SC · Sindh High Court

This case involved a property dispute over land in Jacobabad. A man named Muhammad Siddique claimed ownership of the disputed property, saying he bought it from one Ghulam Sarwar, who in turn had purchased it from Sri Chand. The original plaintiff in the suit argued that the property actually fell within a Katchi Abadi (an informal settlement area), and wanted to add Ghulam Sarwar, Sri Chand, and revenue officials as additional defendants so the court could properly determine the true status and ownership of the land.

The trial court initially refused to allow these new parties to be added, especially since the plaintiff's evidence had already been recorded. However, the District Judge overturned that decision in revision, allowing the new defendants to be joined. Siddique challenged this before the High Court, arguing the request came too late.

The High Court disagreed. It held that under Order I, Rule 10 of the Civil Procedure Code, courts have wide discretion to add necessary parties at any stage of a case, and there is no fixed limitation period for doing so. Since the trial had not yet concluded, adding these parties was appropriate to fairly resolve the real dispute about who owned the land. The petition was dismissed.

This case matters because it confirms that Pakistani courts can add important parties to a lawsuit at any point before final judgment, ensuring disputes are resolved on their true merits rather than being blocked by technical delays.
