Asghar Khan Case
PLD 1992 SC 646)], but the same was upheld. · Supreme Court of Pakistan
This case, popularly known as the Asghar Khan Case, arose from a 1996 petition by Air Marshal (Retd.) Muhammad Asghar Khan alleging that in 1990, senior military and intelligence officials, including then-Army Chief General Mirza Aslam Beg and ISI chief Lt. Gen. Asad Durrani, distributed large sums of money to politicians and political parties to influence the general elections and undermine a particular government. The money was allegedly channeled through Habib Bank/Mehran Bank via businessman Yunus Habib, with lists of recipients later surfacing through affidavits, letters, and statements from those involved, including a disclosure made on the floor of the National Assembly.
The Supreme Court examined extensive evidence, including affidavits, bank records, and testimonies, and found that an "Election Cell" had indeed been set up in the President's Secretariat and that funds were distributed to specific politicians and groups, with key respondents effectively admitting their roles despite some contradictions and denials. The Court held that neither the President nor army/intelligence officials had any constitutional authority to interfere in politics or manipulate elections, and that officers are not obligated to follow illegal orders.
This judgment matters because it formally established, through the country's highest court, that the military and intelligence establishment had unlawfully manipulated a national election by funding politicians, reinforcing the principle that the armed forces and presidency must remain politically neutral under Pakistan's Constitution.

سپریم کورٹ نے وسیع شواہد کا جائزہ لیا، جن میں حلف نامے، بینک ریکارڈ اور گواہیاں شامل تھیں، اور یہ نتی
