Is the court bound to serve notices before passing withdrawal order?

PLD 1990 SC 596) and Ismail vs. Fida Ali and Syyed Iqbal Shabbir (PL · Supreme Court of Pakistan

This case concerns a property dispute where the plaintiff had filed a suit for specific performance of a contract. The trial court had ordered the plaintiff to deposit the remaining sale consideration with the court as a condition for an interim stay order, but the plaintiff repeatedly failed to do so despite multiple opportunities. Just before a scheduled hearing where the defendant sought to have the stay vacated, the plaintiff suddenly applied to withdraw the suit, with permission to file a fresh one, citing vague "legal defects" in the plaint. The trial court granted this withdrawal the same day, without issuing any notice to the defendant and without giving proper reasons.

The defendant challenged this before the Lahore High Court, arguing that by the time of withdrawal, certain rights had already accrued to him through the earlier court orders, and that the trial court should have given him a hearing before allowing the plaintiff to escape the suit and start over.

The High Court agreed. It held that once rights had accrued to a defendant during litigation, the court could not simply allow withdrawal and permission for a fresh suit without notifying the other side and recording proper reasons. The order was found to be vague, lacking specifics about the alleged defects, and issued without a hearing—violating principles of natural justice. The court set aside the withdrawal order and revived the original suit.

This case matters because it clarifies that withdrawal of a suit isn't a mere formality when the other party's rights are already affected—courts must ensure fairness and transparency before granting such permissions.
