Exemption of Golra in the lights of Supreme Court Judgment

PLD 1964 SC 451), Ummatullah v. Province of Sindh (PLD 2010 · Sindh High Court

This Supreme Court suo motu case examined a Joint Venture Agreement between the Capital Development Authority (CDA) and the Multi-Professional Cooperative Housing Society (MPCHS) for developing 54 acres of land in Sector E-11, Islamabad. The matter began after a newspaper report alleged that valuable CDA land had been handed over to MPCHS through a suspicious, underhand deal, prompting the Chief Justice to take notice and call for an official explanation.

CDA explained the land's history: originally part of a larger estate acquired decades earlier, portions had been allotted to local claimants over the years, leaving 54 acres. Despite repeated public advertisements inviting developers to take up the project, the land remained unattractive due to illegal occupation (adverse possession) by squatters, discouraging bidders. Eventually, after a competitive process involving multiple bidders, CDA's Board approved MPCHS's proposal, and a formal agreement was signed in December 2008. MPCHS subsequently cleared the illegal occupants, obtained necessary approvals, and completed most of the construction work without any cost to CDA.

CDA and its counsel argued that all rules, regulations, and transparency requirements had been followed throughout the bidding and approval process, and that no other bidder had objected.

This case is significant because it shows the judiciary's role in scrutinizing government land deals for transparency and legality, especially regarding public land and development agreements involving private housing societies.
