Writ of Quo Warranto Case Law

PLD 1963 S.C. 203) it · Balochistan High Court

This case was a petition filed before the Balochistan High Court by Saifuddin against the Quetta Chamber of Commerce and others, challenging the way the Chamber's Executive Committee had been constituted and its office-bearers elected for the 1981-82 term. The petitioner had also filed a representation under the Trade Organizations Ordinance, 1961, which the government-appointed Director (respondent No. 3) failed to decide. He asked the court to declare the election and the Director's inaction unlawful, and to order fresh, lawful constitution of the committee.

The court dismissed the petition. It held that the petitioner was not an "aggrieved person" entitled to seek such relief, since he had never objected to the election process, the candidates, or the composition of the electoral college at the time the election was actually held. The court also noted that disputed questions of fact are not suitable for resolution under constitutional writ jurisdiction, that an alternative remedy existed (an Arbitration Tribunal, which other members had already approached), and that the petitioner had failed to include all the affected office-bearers and committee members as parties, meaning any adverse ruling would unfairly bind people who had no chance to be heard.

The judgment is significant because it reinforces key limits on writ jurisdiction: courts will not grant relief like quo warranto or mandamus merely on request, disputed facts must go through proper tribunals with evidence, and all necessary parties must be included before a decision can be made against them.
