What are the Functions of Justice of Peace?

This Lahore High Court judgment explains the role and powers of a "Justice of the Peace" and "ex-officio Justice of the Peace" under Pakistan's Criminal Procedure Code, particularly sections 22, 22-A, 22-B and 25. The court traced the historical origins of the concept from England, noting that while some countries gave Justices of the Peace judicial powers over minor cases, in the Indo-Pak subcontinent their role remained limited because an elaborate system of Magistrates already existed to handle judicial matters.
The court clarified that in Pakistan today, an ordinary Justice of the Peace can make certain arrests, call on police for help in preventing crime, and certify or attest documents, but mainly serves as an assistant to the police in keeping peace. An ex-officio Justice of the Peace, which includes Sessions Judges, has the additional power (added in 2002) to direct police on complaints about refusal to register a case, transferring an investigation, or police neglect or misconduct.
Crucially, the court held that none of these powers are judicial in nature. They are purely administrative and ministerial functions, not an exercise of judicial authority to dispense justice.
This matters because it clarifies the limits of what Justices of the Peace can legally do, preventing them from overstepping into judicial territory and ensuring the proper separation between administrative assistance to police and actual judicial decision-making.
