Railway Accident Contributory Negligence Case Law

PLD 1955 Lah. 256; · Sindh High Court

This is a 2011 Supreme Court of Pakistan decision in a railway accident case, where the heirs of persons killed in railway accidents sued for compensation under the Fatal Accidents Act, 1855. The High Court of Sindh had ruled in favour of the victims' families, and the Railways appealed, arguing that the deceased themselves were partly to blame (contributory negligence) and so compensation should be denied or reduced.

The Supreme Court dismissed the Railways' appeals. It held that railways cannot escape liability for accidents caused by their own failure to maintain safety measures, such as keeping crossing gates closed, simply by claiming the victim should have been more careful. The defence of contributory negligence only applies if the railway proves it had taken all proper safety precautions and the victim deliberately bypassed them, for example by climbing a fence or opening a closed gate. Since the gate was admittedly open at the time of the accident, the fault lay with the Railways, which is also vicariously liable for its employees' negligence.

The judges further explained that tort law exists both to compensate victims' families and to deter negligent behaviour by institutions, and that delayed justice undermines its purpose. The court also discussed guidelines for estimating a deceased person's likely working life for compensation purposes, and noted that exemplary damages could be considered in cases of serious negligence.
