This case concerned a dispute over who had the legal right to serve as Chief Executive Officer (CEO) of Pak-Oman Hospital Pasni. The petitioner, Dr. Chakar Riaz, had been posted as CEO on a stopgap basis, approved directly by the Chief Minister. He later challenged his transfer out of the post and the appointment of another person as the new CEO, arguing the government's actions were illegal.
The Balochistan High Court examined the Pak-Oman Hospital Pasni Act, 2021, which clearly lays out that the CEO must be appointed by the Hospital's Board of Governors, based on a panel of three candidates recommended by a Special Selection Committee after a proper merit-based process. The court found that neither the petitioner's original appointment nor the respondent's subsequent appointment followed this legal procedure—both were made through the Health Secretary on the Chief Minister's recommendation, bypassing the Board entirely.
Because both appointments violated the law, the court ruled that neither man could claim a vested right to the post, since rights to public office can only arise from lawful, properly conducted appointments. The court emphasized that when a law specifies a particular procedure, it must be followed exactly, and that temporary or stopgap postings don't create permanent entitlements.
