Muhammad Wassay Tareen V. Government of Balochistan through Chief Secretary and 2 others,

PLC (C.S) 2023 457 · Balochistan High Court

This case involved the former Provincial Ombudsman of Balochistan, who sued the provincial government for refusing to pay him a "Superior Judicial Allowance." When he was appointed in 2013, his terms of service did not include this allowance, and an earlier court petition on the same issue was dismissed in 2018 on the grounds that an Ombudsman is not a judicial officer and therefore not entitled to an allowance meant for judges.

However, the situation changed: the Governor of Balochistan later approved payment of this allowance specifically in the petitioner's favor, and it emerged that previous Ombudsmen had, in fact, been receiving this same allowance. Despite the Governor's approval, the Chief Minister rejected the summary authorizing payment.

The Balochistan High Court found that denying the allowance to this petitioner, while past Ombudsmen had received it, amounted to unjustified discrimination with no rational basis or reasonable distinction to explain the different treatment. The Court held that the Chief Minister had erred both factually and legally in rejecting the Governor's approved summary, and that the Governor's order to pay the allowance was lawful.

The Court allowed the petition and directed the provincial government to release the Superior Judicial Allowance to the petitioner as originally approved by the Governor. The case highlights how constitutional guarantees against discrimination (Article 25) can require equal treatment among people in similar official positions, even when procedural or contractual technicalities are raised as objections.
