Gul Mir Khan and 2 others V. Government of Balochistan through Secretary Education Balochistan Quetta and 4 others,

PLC (C.S) 2023 426 · Balochistan High Court

This case involved three petitioners who applied for teaching jobs in Balochistan's Education Department under a special quota reserved for disabled persons. They challenged a decision that rejected their appeals against not being appointed.

The first two petitioners had applied for Junior Vernacular Teacher (JVT) posts in Zhob district. Only one such post was available under the disability quota. The court examined the test scores and found the person who was actually appointed had scored higher marks than both petitioners. Since that appointment was made strictly on merit among disabled candidates, the court ruled the two petitioners had no valid claim and dismissed their case.

The third petitioner had applied for a Junior English Teacher post in Sherani district and had passed the required National Testing Service exam. However, he was denied an appointment order because officials claimed his university degree wasn't recognized by the Higher Education Commission. During the court proceedings, the Higher Education Commission's own representative confirmed that the university was in fact accredited and verified the petitioner's degree as genuine. The court also had his disability certificate independently verified. Finding no legitimate reason for denying him the job, the court ruled in his favor and accepted his petition.

The case is significant because it applied Supreme Court guidelines on how disability employment quotas should be calculated based on total sanctioned government posts, and it demonstrates that such quota appointments must still be merit-based among eligible disabled candidates, while wrongful denial of a rightful appointment based on incorrect information can be corrected by courts.
