Sajjad Haider Tareen, PDSP, Quetta and 10 others V. The Provincial Police Officer, Balochistan Quetta and 12 others,
PLC (C.S) 2023 170 · Balochistan High Court
This case, decided by the Balochistan High Court, concerned a long-running dispute over how Deputy Superintendents of Police (DSPs) belonging to the police prosecution branch should be treated in seniority lists compared to DSPs from other branches of the Balochistan Police.
Originally, a joint seniority list covering DSPs from all branches, including prosecution, was maintained until 2000. After that, the department began excluding prosecution branch DSPs from the joint list without issuing any separate list for them either. As a result, DSPs from other branches who were junior to prosecution branch officers were promoted to Superintendent of Police ahead of them. Prosecution branch DSPs challenged this exclusion as illegal and discriminatory.
The court examined the relevant service rules and found that while different branches of the police service were organized as separate units, they were not formally designated as distinct "cadres" requiring separate seniority lists under the Balochistan Civil Servants Act, 1974. It also noted that although lower-ranked prosecution staff could not transfer to other branches, DSPs of the prosecution branch faced no such restriction and could serve in other branches after promotion.
The court accepted the petitions, ruling that the department must maintain one joint seniority list for all DSPs regardless of branch, rather than separate lists that disadvantaged prosecution branch officers in promotions. This decision reinforced fair treatment and equal promotion opportunities for civil servants across branches within the same service cadre.
