Dr. Ilyas and another V. Government of Balochistan through Chief Secretary and others ,
PLC (C.S) 2022 770 · Balochistan High Court
Two petitioners, associated with Bolan University of Medical and Health Sciences, challenged Section 15 of the Bolan University of Medical and Health Sciences Act, 2017, before the Balochistan High Court. That provision allowed the Governor, acting as Chancellor, to appoint the university's Vice-Chancellor without needing advice from the Provincial Government, Cabinet, or Chief Minister.
The petitioners argued this violated Article 105 of the Constitution, which requires the Governor to act on the advice of the Chief Minister except where the Constitution specifically says otherwise. The government side argued the Governor, when acting under a special statute like this university law, wasn't bound by that constitutional requirement.
The High Court rejected that argument, holding there is no valid distinction between the Governor's constitutional powers and powers given to him under ordinary statutes. In both cases, he must act on the Chief Minister's advice unless the Constitution itself creates an exception. The court also discussed how the 18th Constitutional Amendment shifted education mainly into provincial control, strengthening provincial autonomy generally.
As a result, the court declared Section 15(1) and (2) of the Bolan University Act unconstitutional and struck them down for violating Article 105.
This matters because it reinforces that governors cannot exercise independent discretion in appointing heads of public universities or similar bodies, and must act on the advice of elected provincial governments, strengthening democratic accountability and limiting gubernatorial overreach in institutional appointments.
