Abdul Rauf and others V. Government of Balochistan through Secretary Services and General Administration Department and others,
PLC (C.S) 2022 1494 · Balochistan High Court
This case involved a group of job applicants who had applied for various government posts in the Mines and Minerals Department of Balochistan after advertisements in 2017 and 2018. The petitioners sat written tests and interviews conducted by a properly constituted Selection/Recruitment Committee, cleared them, and were placed on a merit list recommending them for appointment. However, instead of issuing appointment orders, the government re-advertised the same posts in 2019, citing delays in completing the recruitment process as the reason.
The petitioners challenged this re-advertisement in the Balochistan High Court, arguing it unfairly denied them jobs they had rightfully earned through a fair and completed selection process.
The High Court ruled in favour of the petitioners. It held that the recruitment process had already been substantively completed, with all key steps—tests, interviews, and recommendations—properly finished. The delay in finalizing appointments was an administrative lapse, not something the candidates were responsible for, and such a minor procedural delay could not be used to cancel the entire selection and start over. The court found no irregularity in how the Selection Committee was formed or how it conducted the process. Citing precedent, it held that once a selection process is validly completed, the authorities lose the power to retract or reverse it arbitrarily. The court ordered the government to verify the petitioners' credentials and issue them appointment orders. This judgment reinforces protection for job candidates against arbitrary government reversals after a fair selection process.
