This case involved employees of the Irrigation Department in Balochistan who filed a petition asking the High Court to stop the Public Health Engineering (PHE) Department from constructing dams. The petitioners argued that under the Government of Balochistan Rules of Business, 2012, building dams was exclusively the job of the Irrigation Department, and that assigning dam projects to PHE in the Public Sector Development Program (PSDP) was illegal and encroached on their department's mandate. They pointed to the Irrigation Department's past experience building dams and argued PHE lacked the expertise.
The court dismissed the petition without even examining the merits of the dispute. It held that the petitioners, as ordinary employees, did not have the legal standing ("locus standi") to challenge this government decision. To file such a constitutional petition, a person must show that their own legal or fundamental rights were violated, making them an "aggrieved person." The court noted that the PSDP assignment had already been approved by the Cabinet and the Provincial Assembly, and importantly, the Secretary of the Irrigation Department itself had not objected to the decision. Since the petitioners were not personally affected and had no authority to question internal government business allocation decisions, their petition failed on this threshold issue of maintainability. This case illustrates how courts restrict who can challenge government policy decisions, even when the policy's wisdom is debatable.
