Abdul Karim and others V. Secretary Health Department Government of Balochistan and others,
PLC (C.S) 2020 927 · Balochistan High Court
This case concerned employees hired on one-year contracts by the Health Department, Government of Balochistan, under a Vector Borne Disease Control Program. After passing tests and interviews, they received official offer letters and some were also issued posting orders, with a few actually joining duty. However, before most could be properly posted or paid, the Director General Health Services cancelled their appointments through a letter, without giving any reasons or issuing show-cause notices. Salaries were also withheld even for those who had joined. The employees challenged this cancellation and non-payment before the Balochistan High Court.
The court found that the employees had been recruited lawfully, through a proper process approved by the competent authority. Any delay or failure in issuing posting orders was the department's fault, not the employees'. Since employees cannot start work without being formally posted, they could not be blamed for not reporting for duty. The court also held that cancelling their appointments without notice or explanation was unlawful, and denying them salaries violated Article 3 of the Constitution, which guarantees economic justice and protection from exploitation.
The court declared the cancellation order void, and directed the department to pay the employees' salaries from the date of their offer letters until the expiry of their contract terms. This judgment reinforces that government departments cannot arbitrarily cancel lawful appointments or withhold pay without due process and valid reasons.
