Abdul Nabi Sasoli V. Government of Balochistan, through Secretary Education department and 2 others,

PLC (C.S) 2020 759 · Balochistan High Court

This case involved Abdul Nabi Sasoli, a schoolteacher in Balochistan who had been posted as Controller of the Balochistan Board of Intermediate and Secondary Education (BBISE) in Quetta. After about ten months, the government transferred him out of that position and posted another officer (respondent No. 2) in his place. Sasoli challenged this transfer in the Balochistan High Court, arguing it was premature, violated transfer policy, and that the new officer had already exceeded the maximum allowed deputation period.

The court first addressed whether it even had jurisdiction, since transfer and posting matters are normally treated as service-related issues that only a Service Tribunal can hear, not the High Court. However, since no Service Tribunal was actually functioning in Balochistan at the time, the court held it could still hear the case, as the petitioner had no other remedy available.
