Bibi Maryam and 8 others V. Government of Balochistan, through Secretary Education department and 9 others,

PLC (C.S) 2020 548 · Balochistan High Court

This case is about a group of petitioners from District Noshki who applied for Class-IV (support staff) jobs in a government school after donating land on which the school buildings stood. They took the recruitment test and interview, but the District Recruitment Committee did not select them. They complained to a Complaint Redressal Cell, which recommended they be given preference in appointment because they had donated the land, and the Provincial Ombudsman also asked the government to implement this recommendation. However, the education department did not appoint them, so they approached the Balochistan High Court.

The petitioners argued that there had been an understanding with the education department that in exchange for donating the land, they would have the right to recommend who gets appointed to these posts. The court rejected this argument. It held that no government post can be filled based on a private person's recommendation, and any such agreement is illegal and against public policy. Trading land for a job amounts to effectively selling a public office, which violates the law and the constitutional guarantee of equality (Article 25). The court also cited Section 23 of the Contract Act, which makes agreements void if their object is unlawful. Since the underlying agreement had no legal validity, the petitioners could not demand its enforcement. The petition was dismissed.

This case matters because it reinforces that public employment must be based on merit and lawful procedure, not private deals or favors, even when land or resources are donated for public infrastructure.
