The Religious Affairs and Inter-Faith Harmony Department, Government of Balochistan, advertised vacant posts of Stenographer and Junior Clerk in 2018. Eighteen petitioners, including Usman Ali, applied, took the written test and interview, and were recommended for appointment by the department's Recruitment/Selection Committee. However, before their appointment letters were issued, the Chief Minister imposed a general ban on recruitment across departments. Later, this ban was lifted, and departments were told to complete pending recruitment processes. Instead of issuing appointment letters to the petitioners, whose selection process had already been completed, the department decided to re-advertise the same posts, partly citing concerns that some candidates had crossed the age limit.
The petitioners challenged this before the Balochistan High Court, arguing that since they had already qualified and been recommended before the ban, they were entitled to appointment, and that other candidates for different posts (like Naib Qasid and Chowkidar) had already been appointed on the same basis.
The High Court agreed with the petitioners, finding no valid justification for withholding their appointment orders after their selection process was complete. It held that denying them appointment violated their constitutional rights under Articles 4 and 5, and directed the authorities to issue their appointment orders. The petition was allowed.
