This case is about a government job applicant who challenged the withdrawal of his recommended appointment. Feroz Shah applied for the post of watchman in the Education Department of Balochistan after seeing an advertisement, appeared in the interview, and was placed on a merit list of successful candidates recommended for appointment. However, the department later noted that appointment orders could only be issued against clearly sanctioned vacant posts, and it turned out that the original advertisement had only listed one vacant post, that of a driver, not watchman. No watchman post had actually been advertised. The department subsequently cancelled the earlier approval and issued a fresh merit list for Class-IV posts, which did not include Shah, as all recommended candidates in the new list were for the post of Naib Qasid.
Shah went to the Balochistan High Court, arguing that he had been wrongly excluded due to political influence and favoritism, and asked the court to direct his appointment.
The High Court dismissed the petition, holding that since no vacant post of watchman was ever advertised, Shah had not applied for a properly sanctioned post, and therefore the court could not direct the department to appoint him to a position that did not exist in the advertisement. The court relied on a Supreme Court ruling emphasizing that public appointments must follow proper advertisement of actual vacancies to protect citizens' fundamental right to fair recruitment. This case highlights that courts will only enforce appointment claims based on genuinely advertised, sanctioned vacancies.
