Muhammd Noor V. Government of Balochistan, S&GAD through Secretary and 2 others,
PLC (C.S) 2018 797 · Balochistan High Court
This case involved a government employee, Muhammad Aslam, who was removed from service by the Balochistan government after being absent from duty for an extended period. His departmental appeals against this removal were rejected, and the removal order became final since he did not challenge it before the Service Tribunal. However, following recommendations from several provincial ministers, and on the direction of the then Chief Minister, the government reinstated him into service without following any proper legal procedure for reversing the earlier disciplinary order.
Muhammad Noor, who had a personal dispute with the reinstated employee (both were connected to a criminal case involving an alleged abduction), challenged this reinstatement through a writ petition, essentially asking under what legal authority the reinstatement was made.
The Balochistan High Court found that neither the Governor nor the Chief Minister had any legal power of review or revision to overturn a final disciplinary order under the relevant laws. The Court held that using ministerial recommendations to bypass proper legal channels was improper, that government employees are barred from seeking intervention from assembly members in such matters, and that following an illegal directive does not make it lawful. The Court concluded the Chief Minister had misused his authority, declared the reinstatement order illegal, and set it aside.
The case highlights that political influence cannot override final legal decisions made under proper statutory disciplinary procedures, and that executive officers must not blindly implement unlawful directions.
