Syed Nasrullah V. The Director General Pakistan Sports Board, Islamabad and 2 others,

PLC (C.S) 2018 367 · Balochistan High Court

This case involved a Sub-Engineer who was appointed to the Pakistan Sports Board in 2016 after clearing a written test and interview, and later being regularized. His appointment was initially challenged by a rival candidate in a separate petition, but that challenge was withdrawn after the rival found employment elsewhere. Despite this, the Sports Board later issued a show-cause notice claiming the petitioner's appointment was illegal and had been made on political grounds, wrongly citing the earlier court proceedings as support. Without holding a proper inquiry, the Board terminated his services. His departmental appeals went unanswered, prompting him to approach the Balochistan High Court.

The Board argued that the petition could not be heard because it was a non-statutory organization not governed by formal service rules, meaning constitutional petitions do not apply to its employment disputes, which are treated under ordinary "master and servant" principles.

The High Court agreed that since the Sports Board lacked statutory rules on appointments, promotions, and discipline, a constitutional petition against it was not maintainable. However, the judges noted that the petitioner appeared to have a strong case on the merits, since his termination was based on a misreading of the earlier court order. While dismissing the petition on maintainability grounds, the Court urged the Board to reconsider his case sympathetically and on humanitarian grounds. The ruling highlights limits on constitutional court intervention in disputes involving non-statutory public bodies.

بورڈ کا موقف تھا کہ اس درخواست کی سماع
