Abdul Ghafoor V. Province of Balochistan through Chief Secretary and 3 others,

PLC (C.S) 2017 491 · Balochistan High Court

This case is about a government employee dispute in Balochistan concerning whether a telecom company employee could be transferred to a government department on deputation ahead of a sitting employee's promotion prospects.

Abdul Ghafoor, a government officer eligible for promotion to the post of Assistant Director/Planning Officer, challenged the government's decision to instead bring in Fareedullah, an employee of Pakistan Telecommunication Company (PTCL), on deputation to the same post. Ghafoor argued this violated the Balochistan Civil Servants Deputation Policy 2012 and blocked his own promotion.

The Balochistan High Court ruled in Ghafoor's favor. It held that PTCL employees are not civil servants, so Fareedullah's deputation into a civil service post was legally invalid from the start. The court further found that the deputation had been arranged not out of genuine public interest or administrative necessity, but because a Minister personally directed it - which the court said ministers have no authority to do. It emphasized that secretaries of departments must follow proper rules and resist ministerial directions that violate law or policy, rather than simply complying.

The court declared the deputation notification unlawful and of no legal effect, and directed the authorities to make a regular appointment or promotion to the post following proper legal procedure. The judgment reinforces that government postings must follow established civil service rules and policies, not personal preferences of officials, and protects the promotion rights of eligible civil servants against improper outside appointments.
