Muhammad Akber V. The Secretary, Education Government of Balochistan and 5 others,

PLC (C.S) 2017 29 · Balochistan High Court

This case involved a job dispute in the Balochistan Education Department. The petitioner, Muhammad Akber, held a religious qualification called Shahadat-ul-Aalia (considered equivalent to a B.A.), along with a teaching certificate and intermediate qualification. He applied for two advertised posts, Junior Arabic Teacher and Mo'alam-ul-Quran, took the NTS test, and scored highest among applicants for both positions, placing first on the merit lists.

Despite this, the department refused to issue him an appointment letter, ruling that his academic degrees did not meet the specific qualification requirements for these posts. Instead, appointment letters were given to two other candidates who had scored lower marks. The petitioner challenged this decision, arguing it violated merit and was discriminatory, but his internal appeal was also rejected on the same grounds.

The Balochistan High Court dismissed his petition. It held that the department had not acted illegally, since the competent authority, after review, had determined his degree was invalid for these specific posts, a decision applied uniformly to all candidates without discrimination. The court emphasized that under Article 199 of the Constitution, it cannot interfere in policy matters or resolve factual disputes about degree validity, which require detailed investigation and evidence rather than constitutional review. Since no fundamental right was violated, the petition was dismissed.

This case illustrates the limited scope of judicial review over administrative and policy decisions, even when a candidate has topped a merit list.
