Muhammad Akber V. The Secretary, Education Government of Balochistan and 5 others and 5 others,
PLC (C.S) 2017 29 · Balochistan High Court
This case was about a job appointment dispute in the Balochistan Education Department. The petitioner, Muhammad Akber, had applied through NTS for two teaching posts—Junior Arabic Teacher and Mo'alam-ul-Quran—based on his religious qualification (Shahadat-ul-Aalia, considered equivalent to a B.A.) along with other credentials. He scored the highest marks and topped the merit lists for both posts, but the department refused to issue him an appointment letter, saying his academic degrees did not meet the actual requirements for these positions. Instead, two other candidates with lower marks were appointed. Akber's appeal to the departmental review committee was also rejected on the same grounds, so he approached the High Court, arguing this was unfair and against merit.
The High Court dismissed his petition. It found that the authorities had not acted illegally, since after careful review the competent authority determined his degree was not valid for these specific posts—this was a policy decision applied equally to all candidates, not discrimination against him alone. The Court explained that under Article 199 of the Constitution, it cannot step into factual disputes about the validity of degrees or override policy decisions unless a fundamental right was clearly violated, which was not the case here. Such factual disagreements require detailed investigation and evidence, not constitutional review.
This case matters because it clarifies the limits of judicial power in service and recruitment matters—courts generally will not interfere with administrative or policy decisions unless clear illegality or discrimination is shown.
