Tariq Hussain and others V. Government of Balochistan through Secretary Education Department and 2 others,
PLC (C.S) 2017 1222 · Balochistan High Court
This case involved 44 employees of the Balochistan Text Book Board who had been given leave encashment payments (cash payments for unused leave) for the years 2011 to 2015. Later, a Departmental Accounts Committee objected, saying the payments were calculated incorrectly, using gross salary instead of basic pay, and directed the employees to refund the overpaid amounts. The employees challenged these recovery notices in the Balochistan High Court, arguing the payments had been properly approved and that similarly placed employees in other provinces enjoyed the same benefit.
The court examined the relevant laws, including the Balochistan Text Book Board Ordinance and Revised Leave Rules. It found that the leave encashment rule cited only applied to employees retiring at superannuation, not to serving employees. It also found procedural problems: the body that had approved the payments, described as a "Board of Directors," did not actually exist under the law, only an Advisory Council did, and neither had the power to make binding rules. Only the Text Book Board itself had that authority, and government rules should have applied since the Board's own rules were not properly framed.
However, the court ultimately dismissed the petition not on these merits alone, but because the employees had not first used the available departmental remedy of filing a representation to a higher authority before approaching the court. Since an alternate remedy existed and was not used, the court held the constitutional petition was not maintainable.
