Mian Khan V. Inspector General Police Balochistan and 2 others,

PLC (C.S) 2017 1102 · Balochistan High Court

This case involved a police constable, Mian Khan, whose employment was dismissed in 2014. He appealed to the Balochistan Service Tribunal, which ruled in his favor, but nearly two years passed without the police department implementing that decision. Frustrated by the delay, he approached the Balochistan High Court under Article 199 of the Constitution, asking it to order the authorities to reinstate him and carry out the Tribunal's judgment.

The High Court dismissed the petition, not because it disagreed with the merits, but because it found this was not the right legal avenue. The court explained that under the Balochistan Service Tribunal Act, 1974, the Service Tribunal itself is treated as a civil court when deciding appeals, and therefore has all the powers of a civil court under the Code of Civil Procedure, including the power to enforce its own judgments. This means an employee seeking to enforce a Tribunal ruling should go back to the Tribunal to have it executed, rather than filing a fresh constitutional petition in the High Court.

The judgment matters because it clarifies the proper channel for enforcing Service Tribunal decisions, discourages unnecessary litigation in the High Court, and prevents the High Court from being turned into an "executing court" for Tribunal orders. It reinforces that Tribunals must develop their own mechanisms to ensure compliance with their rulings, protecting the efficiency of the service dispute resolution system.
