PLC (C.S) 2016 1184 · Balochistan High Court

Petitioners were candidates who took the departmental examination for Assistant Commissioners/Tehsildars, conducted by the Balochistan Public Service Commission (BPSC). After completing their papers, BPSC withheld results and later disclosed, through meeting minutes, that it had cancelled the Revenue Law-II paper based on an Inquiry Committee's recommendation. That committee had re-evaluated only about 10% of answer sheets, chosen at random, and apparently suspected copying, though no candidate was ever accused specifically, summoned, or given a chance to explain. The petitioners challenged this cancellation before the Balochistan High Court.

The court first addressed whether the petition was even allowed to be filed in the High Court, given that civil servants normally must appeal to the Service Tribunal. It held that BPSC is not a "departmental authority" and its actions during recruitment are not covered by that appeal route, so the petitioners rightly came directly to the High Court.

On the merits, the court found no evidence of cheating—correct answers alone cannot prove copying, and suspicion or presumption cannot substitute for proof. Since candidates were never given notice or a hearing before their paper was cancelled, this violated natural justice. The court also noted BPSC's own rules did not permit re-evaluation of competitive exam answer sheets in this manner.

The court declared the cancellation and the Inquiry Committee's findings null and void, and directed BPSC to announce the result immediately. This case reinforces that public bodies must follow fair proced
