Payo Khan alias Kakay V. The State,

PLC (C.S) 2015 393 · Balochistan High Court

Payo Khan was convicted by a trial court in Quetta for possessing an unlicensed rifle, a pistol, ammunition and a handgrenade, and sentenced to seven years plus three years imprisonment under the Explosive Substances Act and Pakistan Arms Ordinance. The prosecution's case was that police acted on secret information and raided his house, recovering the weapons.

On appeal, the Balochistan High Court found serious flaws in how the case was handled. No one had actually asked the accused to produce a license for the weapons before charging him, and simply possessing arms is not itself illegal unless a person fails to produce a license when asked. The recovery process was also questionable: the memo documenting what was seized was supposedly prepared at the scene at 3:50 a.m., but records showed it was actually written up nearly sixteen hours later at the police station, after the case had already been registered. The witness to the recovery admitted he wasn't even present at the raid and gave his statement later at the police station, not on the spot as required. No independent, respected member of the community was included in the raid, as normally expected in such proceedings.

Given these serious doubts about whether the recovery was genuine and properly documented, the High Court ruled that the prosecution had failed to prove its case beyond reasonable doubt. It set aside the conviction and sentence, acquitting Payo Khan. The case highlights why courts insist on strict, honest procedure in police recoveries — sloppy or fabricated paperwork can undermine even serious criminal charges.
