Muhammad Akram Baloch V. Akbar Askani and others,

PLC (C.S) 2015 346 · Balochistan High Court

This case comes from an election dispute in Balochistan. After Akbar Askani won a Provincial Assembly seat by 54 votes from Constituency PB-50 Kech-III, the losing candidate, Muhammad Akram Baloch, challenged the result before the Election Commission, alleging rigging and corrupt practices. When that petition was dismissed, he filed a formal election petition before the Election Tribunal.

The specific issue decided here was procedural: while the petitioner had listed his proposed witnesses' names in the petition, he had not attached their sworn affidavits, as required by the Representation of the People Act, 1976. He argued this requirement was merely directory, not mandatory, and asked the Tribunal to still allow him to produce these witnesses, claiming they had been inaccessible at the time of filing.

The Tribunal rejected this request. It held that although filing affidavits is not backed by a specific penalty making it strictly mandatory, a party who fails to submit them—or omits witnesses from the list—must show "good cause" before being allowed to call such witnesses. Simply asserting that witnesses were unavailable was not enough to meet this standard. The Tribunal emphasized that affidavits serve an important purpose: informing the opposing side in advance what evidence to expect, enabling proper cross-examination and preventing fabricated testimony.

The case matters because it clarifies the evidentiary discipline required in election petitions and limits attempts to introduce witnesses without proper justification.
