This case is about two government job appointments in Balochistan's Culture Department that were challenged in court for being made unfairly. In one petition, a man contested the appointment of two people as Art Teachers, arguing they lacked the required qualification (a B.A. in Fine Arts) and two years' experience, and that their names did not even appear on the official merit list, while his own name topped it. In the other, petitioners challenged appointments to lower-grade posts of Mali (gardener) and Farash (orderly) on similar grounds of being bypassed despite ranking higher on merit.
The High Court found serious irregularities. The Chairman of the Departmental Selection Committee was on leave at the time, so a Deputy Director, who had no authority to do so, advertised the posts, convened the meeting, and signed the recommendations and merit list himself. This violated the Balochistan Civil Servants (Appointment, Promotion and Transfer) Rules, 2009. The court also found the appointed candidates lacked the required qualifications, experience, and artistic skill for the Art Teacher posts.
The court ruled that these appointments were illegal and tainted by bad faith on the part of the selection committee members. It struck down the appointments and ordered disciplinary action against those responsible. The case highlights the importance of following proper procedure and merit in public sector hiring, and shows courts will intervene when recruitment processes are manipulated.
