This case involved ten petitioners who wanted to apply for Pharmacist/Drug Analyst and Drug Inspector posts advertised by the Balochistan Public Service Commission in a local newspaper. The advertisement set a closing date of 7th April 2014 for submitting applications, but the petitioners' final year Pharm-D results were only announced on 12th April 2014, after the deadline had passed. They asked the university Vice-Chancellor to request an extension on their behalf, but the Public Service Commission did not grant one. The petitioners then went to the Balochistan High Court, arguing that fixing a strict deadline had no legal backing and that the date should be extended to accommodate them.
The High Court dismissed the petition at the outset. It found that the petitioners had never actually deposited the required application fee or submitted any application form, so they could not genuinely claim they were ready to apply but were merely blocked by the late results. The court also noted they could have submitted their qualifications later, before any test or interview, but failed to do so. Relying on earlier precedents, the court held that setting deadlines for applications is a policy matter within the Public Service Commission's discretion and has statutory backing, so courts should not interfere absent a violation of rules or bad faith. Since no such violation was shown, the petition was rejected. The case underlines that courts generally will not second-guess administrative deadlines in recruitment processes.
اس مقدمے میں دس درخواست گزار شامل تھے جو بلوچستان پبلک سروس کمیشن کی جانب سے مقامی اخبار میں دی گئی اشتہار کے مطابق فارماسسٹ/ڈرگ اینالسٹ اور ڈرگ انسپکٹر کی آسامیوں کے لیے درخواست دینا چاہتے تھے۔ اشتہار میں درخواستیں جمع کروانے کی آخری تاریخ 7 اپریل 2014 مقرر کی گئی تھی، لیکن درخواست گزاروں کے فارم ڈی کے حتمی سال کے نتائج 12 اپریل 2014 کو، یعنی مقررہ تاریخ گزر جانے کے بعد، اعلان ہوئے۔ انہوں نے یونیورسٹی کے وائس چانسلر سے درخواست کی کہ وہ ان کی جانب سے تاریخ میں توسیع کی درخواست کریں، مگر پبلک سروس کمیشن نے کوئی توسیع نہیں دی۔ اس کے بعد درخواست گزاروں نے بلوچستان ہائی کورٹ سے رجوع کیا اور یہ موقف اختیار کیا کہ سخت آخری تاریخ مقرر کرنے کی کوئی قانونی بنیاد نہیں تھی اور ان کی خاطر تاریخ میں توسیع کی جانی چاہیے۔
