Ghulam Mustafa and 4 others V. Evacuee Trust Property Board, Government of Pakistan through Chairman and 3 others,

PLC (C.S) 2015 1513 · Balochistan High Court

This case involved a dispute over the transfer and posting of two employees (respondents 3 and 4) as Tehsildars in Balochistan's Revenue Department. Five civil servants already working in that department challenged these appointments, arguing that the two individuals were actually employees of the Evacuee Trust Property Board whose initial hiring had been irregular, and that placing them on deputation as Tehsildars violated civil service rules.

The evidence showed the two employees had first been appointed on a temporary work-charge basis, later "regularized," but the Board itself admitted on scrutiny that these appointments were bogus and illegal. Despite this, they were sent on deputation to the Revenue Department with government approval.

The Balochistan High Court ruled that since all parties involved were civil servants, the proper forum for resolving such disputes was the Service Tribunal, not a constitutional petition in the High Court. The petitioners had not pursued that remedy, so the petition was not maintainable in the High Court.

However, the Court still expressed concern that both the lending and borrowing government departments knew about the illegal appointments yet stayed silent for a long time. It ordered that the deputation should not be extended, directed that the two employees be sent back to their original department without delay, and instructed the parent department to take disciplinary action against them and against officials responsible for their improper appointment and transfer.

The case highlights how courts enforce proper civil service procedures while respecting jurisdictional boundaries between courts and specialized tribunals.
