Talal Haleem and 3 others V. Principal Bolan Medical College, Quetta and 4 others,

PLC (C.S) 2015 1455 · Balochistan High Court

This case concerns admissions to Bolan Medical College, Quetta for the 2014-15 academic year. Four male students who had passed the entry test challenged a rule in the college prospectus reserving 50% of MBBS seats for female candidates and 50% for male candidates. They argued this quota system was discriminatory, arbitrary, and violated their constitutional rights, disadvantaging male applicants who had qualified on merit.

The college and health authorities defended the policy, arguing it was meant to address practical problems such as female doctors being reluctant to serve in rural areas, women leaving the profession after marriage, and the high cost of training doctors who might not practice.

The Balochistan High Court ruled in favor of the petitioners. It held that while Article 25 of the Constitution allows reasonable classification between groups if there is a rational and justifiable basis, the authorities in this case failed to provide credible justification for assuming women wouldn't ultimately work in medicine. The Court noted women already serve across many professions including law enforcement and administration. It concluded the gender-based quota amounted to unconstitutional discrimination rather than a reasonable restriction, and ordered the disputed provision removed from the prospectus, directing that admissions instead proceed under the college's earlier admission policy.

This decision matters because it reinforces that gender-based quotas must be backed by solid justification and cannot rest on generalized assumptions, upholding constitutional equality principles in access to professional education.
