This case involved a dispute over age eligibility for a government teaching post in Balochistan. The petitioner, Rehmat Sanober, applied for a Lecturer (Urdu) position after the Balochistan Public Service Commission advertised the post in February 2013, offering a ten-year relaxation in the upper age limit under the government's policy then in effect. She was found eligible, passed the written test topping her zone, cleared the interview, and was officially declared successful through a press release. However, on the very same day, a second press release was issued cancelling her selection, claiming she was over-age based on a new notification issued later that reduced the age relaxation, and another candidate was declared eligible instead.
The High Court ruled in her favor. It held that the government could not apply the later notification retrospectively to undo rights she had already earned under the rules in force when she applied. Since she met the age criteria at the time of the advertisement, passed all stages of selection, and was recommended for appointment, a vested right had accrued to her that could not be taken away without giving her a hearing. The court also found the relaxation policy did not violate any law or fundamental rights.
The court set aside the cancellation press release and directed the government to issue her appointment letter immediately. This case underscores the principle that laws and policy changes generally apply prospectively, and that vested rights already earned through fair process cannot be arbitrarily withdrawn without due process.
