Registrar, High Court Of Balochistan, Quetta V. Mazar Khan and others,
PLC (C.S) 2015 1182 · Balochistan High Court
This case involved civil servants who had gone to civil or Qazi courts and obtained decrees allowing them to change their officially recorded dates of birth, without making the Balochistan government a party to those lawsuits. The High Court took up the matter on its own initiative (suo motu), using its revisional powers under Section 115 of the Civil Procedure Code, after concerns emerged about such practices.
The court held that date-of-birth and other service-record matters for civil servants fall under the special jurisdiction of Service Tribunals, not ordinary civil courts. Since the government was never made a party to these suits, any decrees obtained were not binding on it. The court also noted the civil servants had waited decades (36 years and 5 years in these cases) before challenging their recorded dates of birth, which undermined the credibility of their claims and suggested they had earlier accepted the correct record.
The court ruled that such decrees, passed without proper jurisdiction, were nullities and could be challenged at any stage. It set aside the judgments and decrees altering the dates of birth, and directed the government to review all similar cases, take action against affected employees (including possible dismissal, retirement, and recovery of extra salary paid), consider criminal cases if forged documents were used, and discipline any officials who were negligent or complicit. This judgment matters because it protects the integrity of government service records and limits misuse of civil court decrees to gain undue service benefits.
