Independent Media Corporation (PVT.) LTD. through Attorney and another V. Prosecutor General, Quetta and 7 others,

PLC (C.S) 2015 1143 · Balochistan High Court

This case involved Independent Media Corporation and a co-petitioner, connected to a controversial morning show hosted by Dr. Shaista Lodhi on Geo Entertainment, aired on 14th May 2014, where a religious song (Kalam) was performed in a manner alleged to be blasphemous and insulting to the Prophet's family (Ahl-e-Bait). Although the host publicly apologized within hours, multiple FIRs (criminal complaints) were registered against the petitioners in different police stations across Balochistan, under blasphemy laws and anti-terrorism provisions, leading to separate criminal trials proceeding simultaneously in different courts for the same incident.

The petitioners approached the Balochistan High Court, arguing that facing multiple trials for one and the same offence amounted to double jeopardy and abuse of the legal process, and asked the court to quash all but one of the proceedings.

The High Court examined the law under Section 185 of the Criminal Procedure Code, which deals with conflicts between courts trying related cases.
