Ghulam Qadir V. Governor of Balochistan through Personal Secretary, Quetta and 3 others,

PLC (C.S) 2015 1085 · Balochistan High Court

This case involved a government school teacher, Ghulam Qadir, whose service was terminated in 2000. He filed repeated representations against his termination over several years, but these went undecided. Eventually, after a delay of about nine years, he filed a complaint with the Provincial Ombudsman of Balochistan, who ruled in his favour and set aside the termination. The Governor of Balochistan, acting as the appellate authority, later overturned the Ombudsman's decision. The teacher then challenged the Governor's order before the Balochistan High Court.

The High Court dismissed the petition. It held that the Ombudsman had no legal authority to hear complaints relating to a civil servant's terms and conditions of service, such as termination from employment - such matters fall exclusively within the jurisdiction of the Service Tribunal under the Balochistan Service Tribunal Act. Since the Ombudsman lacked jurisdiction from the outset, his decision condoning a nine-year delay without any formal application or valid justification was void, and the question of limitation became irrelevant. The court clarified that a civil servant aggrieved by termination must seek relief from the Service Tribunal, not the Ombudsman.

This judgment matters because it reinforces the boundary between the Ombudsman's complaint-resolution powers and the specialized jurisdiction of Service Tribunals over civil servants' employment disputes, ensuring such disputes are routed to the correct forum.
