Ghulam Hussain V. Chairman/Secretary S&GAD, Housing Allotment Committee, Quetta and 2 others,
PLC (C.S) 2014 219 · Balochistan High Court
This case involved a dispute over a government-owned residential quarter (Quarter No. H-4, Wahadat Colony, Quetta) in Balochistan. The petitioner, Ghulam Hussain, a junior clerk, was occupying the house and claimed he was entitled to have it formally allotted to him, arguing the previous allottee had asked for it to be given to him when he vacated. He filed a civil suit seeking a declaration of his right to the property and challenging the later allotment of the same house to another government employee, respondent No. 3, asking that this allotment be cancelled and that he not be forcibly evicted.
The trial court dismissed his suit, finding he had no legal right or cause of action, and the appellate court upheld this decision. Ghulam Hussain then approached the Balochistan High Court through a civil revision petition, arguing the lower courts had not properly framed issues or considered evidence.
The High Court examined the relevant allotment rules and found that merely occupying a house without proper permission from the housing authorities does not create a legal right to that house. Someone in such a position is an illegal occupant, not someone with a valid claim, and authorities can lawfully order such a person to vacate. The court also clarified a procedural point: under the law, a court can reject a plaint for lacking a cause of action, but it cannot simply dismiss the entire suit on that basis. This distinction matters because it affects how such cases should be properly disposed of by trial courts.
