Shaan Sher Tareen V. Registrar, Allama Iqbal Open University, Islamabad and 2 others,

PLC (C.S) 2014 1138 · Balochistan High Court

The petitioner, a Regional Director at Allama Iqbal Open University's Quetta campus, was accused of corruption after forwarding travel expense vouchers worth Rs.38,380 submitted by a part-time tutor. Following inquiries, the University's competent authority imposed the major penalty of compulsory retirement on him in 2007. He appealed to the University's Executive Council, but the appeal was delayed and eventually decided against him by a three-member committee rather than the full Council. He then challenged this in the Balochistan High Court.

The University argued the petition was not maintainable, claiming the dispute was a service matter barred from High Court review under Article 212 of the Constitution, and that only the Service Tribunal had jurisdiction. The Court rejected this, holding that Article 212's bar does not apply to University service matters, and since the University's own law provided no further remedy against the appellate authority's order, the High Court could step in under Article 199.

On the merits, the Court found no evidence that any money was actually drawn using the vouchers, meaning the University suffered no loss, and no proof existed that the petitioner failed to verify the vouchers or attempted embezzlement. Since the inquiry committees never established wrongdoing, the compulsory retirement was ruled unjustified and set aside. The Court ordered the petitioner's reinstatement with full back benefits from the date his service was ended, recognizing the years of hardship he faced during the prolonged proceedings.
