Haroon-ur-Rashid v. Registrar High Court,

PLC (C.S) 2013 81 · Balochistan High Court

This case dealt with recruitment to judicial posts in Balochistan—Additional District and Sessions Judges, Civil Judges/Judicial Magistrates, and Qazis—advertised by the Registrar of the Balochistan High Court in 2011-2012. Several groups of petitioners challenged different aspects of the recruitment process through constitutional petitions.

One group, Assistant District Attorneys, complained they were being wrongly barred from applying for the post of Additional District and Sessions Judge. The court held that under the applicable service rules, anyone who is a law graduate from a recognized university and has practiced as an advocate for at least five years is eligible, and Assistant District Attorneys meeting these criteria could not be excluded. Their petition was allowed.

Another set of petitioners challenged the reserved quota seats set aside for disabled persons, women, and religious minorities in the recruitment. The court rejected this challenge, holding that women and minorities form a reasonable class under the Constitution's equality provisions, and that reserving quota for them is neither illegal nor unconstitutional. Similarly, though disabled persons are not explicitly mentioned in the Constitution, they too qualify as a reasonable class, especially given the existing law protecting disabled persons' employment rights. The quota system was therefore upheld as valid.

The judgment matters because it clarifies eligibility rules for judicial recruitment and confirms that affirmative-action quotas for disadvantaged groups are constitutionally permissible in Pakistan.
