This case involved a dispute over a lecturer position at a government college in Balochistan. The petitioner, Nasir Mehmood, had applied for a Lecturer in English post at Balochistan Residential College Turbat and stood fourth on the merit list. Separately, another candidate, Adnan Riaz, was appointed as a lecturer at Cadet College Panjgur based on a "hope certificate" from his university, which predicted he would pass his final Master's exam, even though he had not yet completed his degree. When it became clear his results would be delayed, his appointment was cancelled, and the college decided to re-advertise the post. The petitioner argued that since he was next in line on the merit list, he should be given that position instead.
The Balochistan High Court dismissed the petition. It found that the petitioner had never applied for the Cadet College Panjgur post in the first place, only for the Turbat position, so he had no claim to the vacancy created by Adnan Riaz's removal. The court held that the decision to re-advertise the post was lawful and not something requiring judicial interference, though it left the petitioner free to apply when the position was re-advertised.
Importantly, the court strongly criticized the practice of appointing candidates based on "hope certificates" - documents merely predicting future exam success. It ruled that required qualifications must be completed before applying for a job, and disapproved of any government or institution accepting such certificates in the future.
