Gul Muhammad v. State,

PLC (C.S) 2012 98 · Balochistan High Court

This case involved Gul Muhammad, who was convicted by an Anti-Terrorism Court of murdering three people, including a child, and sentenced to death on three counts. He had accused his wife of "siyahkari" (illicit relations) and, when her family refused to hand her back to him, he shot and killed her brother, along with an aunt and a young boy, in the middle of the night. He appealed his conviction, while the trial court separately referred the case for confirmation of the death sentence.

The Balochistan High Court upheld the conviction and sentence. It found the eyewitnesses credible despite being relatives of the deceased, noting their account matched medical evidence and the recovered murder weapon. The court rejected the appellant's attempt to escape anti-terrorism jurisdiction, ruling that killings carried out under the guise of "honour" or "siyahkari," where a person takes the law into his own hands, create fear and panic in society and therefore properly fall under the Anti-Terrorism Act. The court also held that even though the parties had reached a compromise, private individuals cannot compound such offences under this special law because they are considered crimes against the State, not just the victim's family. The court emphasized that honor-based killings are un-Islamic and illegal, and cannot justify reduced punishment. This case matters because it reinforces that "honour killings" cannot be treated as private family matters or escape strict anti-terrorism accountability through compromise.
