Abdul Malik v. Government of Balochistan,
PLC (C.S) 2012 736 · Balochistan High Court
This case involved petitions filed in the Balochistan High Court by sitting Provincial Ministers and Senators seeking to stop the national census from being conducted in Balochistan. The petitioners argued that census-taking was inappropriate because of a large presence of Afghan refugees, poor law and order conditions, and population displacement due to conflict in districts like Dera Bugti and Marri, and floods in Naseerabad. They feared the census would inflate Balochistan's population figures in ways harmful to the province's interests.
The court rejected these arguments. It noted that six general elections had already taken place since the Afghan refugee influx began, without this issue being raised, and that refugee numbers had actually decreased since the 1981 and 1998 censuses. The court pointed out that maintaining law and order was the government's own responsibility, and since two petitioners were sitting ministers, their argument effectively amounted to admitting their own government's failure. The court also observed that an accurate census could benefit Balochistan, since National Assembly seats are allocated based on population, potentially giving the province more representation.
The court held that deciding whether and when to conduct a census is a political and administrative decision for the Federal Government, not something for courts to interfere with. It emphasized the practical importance of census data for planning schools, hospitals, and public services. The petitions were dismissed, and the census was allowed to proceed.
